I believe you will find that the picture is a advertising picture, used by Ford to promote the first Mercury, being introduced in 1939. I doubt the Ohio SP ever used convertibles as police cars.

The grill and hood are completely different on the 1939 Mercury.

It's a 1938 Ford Deluxe.
1938 was an odd year for Ford. The Deluxe model looked like your photo; the Standard models looked like their 1937 line.

1939 was the same way. The '39 Standard looked a great deal like the '38 Deluxe and the '39 Deluxe was new.
